Herbert A. Smith Jr. has been practicing law in New York State for over 36 years in the areas of divorce and family law, criminal law, commercial law, real property law, trusts and estates law, municipal law, labor law and election law.
Mr. Smith has handled all aspects of divorce and family law from inception to trial, including high net worth divorce matters, custody, visitation, child support, maintenance/alimony, neglect/abuse, paternity, grandparents‘ rights, domestic violence, and Child Protective Service proceedings throughout the New York region. Mr. Smith served as the Principal Law Clerk/Confidential Law Secretary to a dedicated matrimonial Supreme Court Justice wherein he drafted decisions for over 500 motions, trials and hearings and conducted hundreds of conferences. Additionally, Mr. Smith personally tried scores of Supreme, Family, Surrogate’s and District Court cases from inception to conclusion and argued scores of appeals (including Appellate Division and Court of Appeals), and also appeared in many federal cases and trials.
Mr. Smith is also admitted in the Southern District of New York and the Eastern District of New York Courts as well as the United States Supreme Court.
